Yes! The majority of MLSs have specific requirements about the copyright ownership of any listing photos that you post, whether virtually staged or not. Stuccco provides you with full copyright ownership of the virtually staged images, therefore all of our virtual staging services are compliant with the MLS terms of use in Washington DC.
The primary Washington DC MLS is BrightMLS, although there are a few alternatives like DNK Real Estate.
Make sure you have a full understanding of the rules and regulations for your MLS. For example, BrightMLS provides specific terms of use for listing photos, stating:
“Unless otherwise noted, the Sites, and all materials on the Sites, including text, images, illustrations, designs, icons, photographs, video clips and other materials, and the copyrights, trademarks, trade dress and/or other intellectual property in such materials (collectively, the “Contents”), are owned, controlled or licensed by Bright and are protected by U.S. and international copyright laws. Bright-owned trademarks or logos displayed on the Sites are owned by Bright.”
There are no specifications or requirements for virtual staging. However, Stuccco strongly recommends that you take care to use virtual staging legally and ethically.
In order to do that, we also strongly recommend that you disclose virtual staging on the listing photos, in the description, and include non-staged photos. This will keep you compliant with any MLSs. Plus, just as importantly, it also prevents you from making potential buyers feel misled or confused.
