Yes. California MLSs allow real estate professionals to use virtually staged photos when listing and marketing properties. Stuccco grants real estate professionals the right own and use the virtually staged photos Stuccco produces for them, making Stuccco's virtual staging services compliant with Los Angeles and Southern California MLS terms of use.
These are the three largest Los Angeles Multiple Listing Services: California Desert Association (CDAR MLS), California Regional Multiple Listing Service (CRML), The MLS (TheMLS/CLAW).
We recommend that you look into the terms of use for your MLS for full details if you haven't done so already. Most MLSs have strict rules about the copyright of the images you share on your listing.
Here is an excerpt from CDAR’s Rules and Regulations:
“By submitting photographs/images, including but not limited to photographs, images, graphics, audio and video recordings, virtual tours, drawings, renderings or any other representations (collectively referenced in these Rules 28 as photographs and or images) to the MLS, the Participant and/or Subscriber represents and warrants that he or she either owns the unlimited and unencumbered right to submit, convey to the MLS all rights to the photographs/images, reproduce and display such photographs or has procured such rights from the appropriate third party, and has the authority to grant and hereby grants the MLS and the other Participants and Subscribers the right to reproduce and display the photographs in accordance with these rules and regulations.”
In addition, some MLSs also have a clause that all photos and images uploaded on a listing must be, “True, accurate, and complete.” When you use virtual staging in your listing photos, we highly recommend that you upload the original photo as well as the virtually staged version of the original photo. We also recommend that you disclose the use of virtual staging in the listing description. Doing this not only keeps you compliant with your MLS, it also prevents potential buyers from feeling misled or confused.
